Introduction

This document (hereinafter referred to as “TOS”) records the terms and conditions that apply to the access and use of the Website "https://dimemoney.club" and its mobile applications, that may become available on the android and iOS platforms (collectively be referred to as "Website"), which is operated by Streettribe Technologies Private Limited, (hereinafter collectively be referred to as "Company" or "Dime" or “We” or "Us"), incorporated under the laws of India and registered under the Companies Act, 2013.

Terms

By accessing the website at https://dimemoney.club, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

These TOS along with Privacy Policy describes our relationship with you and will be subject to the rules, guidelines, policies, terms, and conditions applicable to any specific service that is provided through this Website and they shall be deemed to be incorporated into this TOS and shall be considered as part and parcel of this TOS.

  • All trademarks, service marks, trade names, logos, copyright and any other intellectual property rights on Dimemoney Platform and its content are either owned by us or licensed to us. All such rights are protected by intellectual property laws in India and around the world, and all rights are reserved. Any use of Dimemoney Platform and its contents, other than as specifically authorised by the Company is strictly prohibited. Any rights not expressly granted herein are reserved by us.
  • The trademarks, service marks, trade names, logos and other branding owned by third parties and used or displayed on or via Dime Money Platform (collectively, "Third Party Mark(s)") may be trademarks of their respective owners, who may or may not endorse or be affiliated with or connected with us. Except as expressly provided in these Terms of Use, or in terms provided by the owner of a Third-Party Mark, nothing in these Terms of Use should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any of our or any Third-Party Marks that are used, without the respective owner's prior written permission, in each instance. All goodwill generated from the use of our trademarks will benefit us exclusively.

AVAILABILITY OF Dimemoney PLATFORM

We make no representations and provide no warranties that:

  • Dime Money will be made available at any specific time or from any specific geographical location;
  • your access to Dime Money will be continuous or uninterrupted; or
  • Dime Money will be accessible or optimised on all browsers, computers, tablets, phones or viewing platforms.

We reserve the right to suspend access to all or part of the Dime Money Platform for any reason, including for business or operational reasons, such as improving the appearance or functionality of the Platform, content updates, periodic maintenance, or to resolve any issues that we become aware of.

Dime Money is provided for users in India only. Although it may be possible to access Dime Money from other countries, we make no representation that the Dime Money is compliant with any legal requirements in force in any jurisdiction other than India or that the content available on the Dime Money Platform will be appropriate for users in other countries or states.

Changes we may make to these Terms of Use and other documentation

  • We reserve the right to update these Terms of Use, our privacy policy, Product-specific Terms and Conditions, our cookies policy and any other policy, process or document referred under terms of Use from time to time. We may change our Terms of Use and other documentation for any reason, including:
    • to reflect any changes in the way we carry out our business;
    • to account for any changes we make to Dime Money Platform, including, without limitation, any new features or functionality we provide, any adjustments to the means by which we provide notices to you, or any changes in the conten
    • accurately describe our current data-processing activities so that you are kept up to date with our latest practices;
    • to ensure that our documentation complies and remains compliant with any and all current and future applicable laws, regulations and official guidance issued by any of the regulators or any other government or Govt. Approved agencies.
  • Only if it is mandated by law, we will provide you with notice of any changes in these Terms of Use or the other documentation referred to in them by posting a notice on our Platform and/or by posting an updated version of these Terms of Use or other such documentation.
  • By continuing to access Dime Money Platform after we have updated our Terms of Use, terms and conditions and/or user content agreement, you agree to be bound by those updated versions. You also acknowledge and agree to abide by the ”Terms of Use” that by continuing to access Dime Money after we have updated our privacy policy and/or our cookies policy, that the practices set out in those updated policies will apply to our handling of your information and our use of cookies and similar technologies.
  • You must check these Terms of Use and all other documentation referred to in them each time you access Dime Money Platform in order to ensure that you are aware of the terms that apply to you at that time

Declaration by user

    By accepting these TOS, you hereby declare and confirm that:
    • You are a resident of India,
    • Above the age of 18 (eighteen) years,
    • have the capacity to enter into a legally binding contract as per the Indian Contract Act, 1872, and
    • are not barred or otherwise legally prohibited from accessing or using the Website under the laws of India or any applicable law.

Registration of an account

If we provide you with account information or any other relevant information such as a username, user ID, identification number, account code and/or password, you must keep such information confidential and secret and not disclose it to anyone. All account information is provided for use by the named account holder only, and not for any other person. You are responsible for any consequences of unauthorised access to your account due to any disclosure of your account information to any third party knowingly or unknowingly.

  • Where we provide you with the option to select your own login information, including a password, we recommend that you do not supply login information unique to your own use of Dimemoney Platform, and do not use information from other accounts you may hold with other Platforms or any easily discoverable information about you. You are responsible for any/all consequences of unauthorised access to your account due to any disclosure of your login information or other credentials to any third party knowingly or unknowingly.
  • When creating your account, you must provide accurate and complete information. You agree that you will not solicit, collect or use the login credentials of other individuals at any point of time. We prohibit the creation of, and you agree that you will not create, an account for anyone other than yourself. You also represent that all information you provide to us upon registration and at all other times are true, accurate, current, and complete. You agree to update your information immediately upon any change as it is necessary to maintain its truth and accuracy.
  • We reserve the right to withdraw access to your account without notice for any actual or suspected breach of these "Terms of Use" or any other documentation referred to in them, including, without limitation, where we suspect that there has been unauthorised access to your account, or any unauthorised disclosure of your login information. Further the account can be suspended on account of any regulatory, legal or lawful obligation prescribing or indication action on the account or on account of any obligation arising on Dimemoney.
  • You agree to notify Dime immediately of any unauthorized use of your account or any other breach of security. Dime shall not be liable for any unauthorized use or access of your account.
  • If you know or suspect that the confidentiality of your login information has been compromised, for example, by the disclosure of such information to any third party, you must immediately change your password. If you are unable to change your password, you must immediately notify us by email, at admin@dimemoney.club
  • Permitted use of information on Dimemoney Platform
    • The content on Dimemoney Platform is provided for your personal, private and non-commercial use only. You should not print or share the content from Dimemoney Platform for any purpose. However, the sharing of content with the approval (written consent) is permissible only for lawful purposes, private and non-commercial purposes. You may not otherwise extract, reproduce or distribute the content of without our prior written consent.
    • Whenever you print, download, share or pass on content from Dimemoney Platform to others, you must not make any additions or deletions or otherwise modify any text, you must not alter or change any images, media or graphics in any way, you may not remove any accompanying text from such images, media or graphics, and you must ensure that all content passed on to any third party is an accurate representation of the content as it appears on Dimemoney Platform.
    • You are completely prohibited from using any software / Artificial Intelligence software or any other technology including robots, spiders, data mining or scraping technology or any similar third-party tools for the extraction or reproduction of any data or content from Dimemoney Platform without our prior written consent.
  • Viruses and other harmful content
    • We do not guarantee that Dimemoney Platform is free from all the errors, and it is technologically secure to restrict all viruses or other malicious software/contents. However, to the best of our ability, we will dedicate our resources to keep Dimemoney Platform secure.
    • We shall not be responsible for any bugs or viruses on Dimemoney Platform, or any software that might be transferred to your computer from Dimemoney Platform, or any consequences which the presence or operation of such programs may have.
    • You must ensure that you have in place up-to-date and effective anti-virus protection and firewall on your computer or other browsing device.
    • You must not upload or otherwise introduce to Dimemoney Platform any viruses, malware, spyware, adware, Trojan horses, worms, logic bombs, time bombs, keystroke loggers or any other programs or code that is harmful or malicious in nature.
    • You must not use any third parties' system, software or technology to attempt to gain unauthorised access to Dimemoney Platform, our servers, systems, hardware, software or data.
    • You must not attempt to perform any denial-of-service type attack on Dimem

EXCLUSIONS AND LIMITATIONS OF LIABILITY

    We exclude all our liability to you where it would be lawful to do so, except for the cases wherein liability is enforced regulatorily or by any law as applicable to us. If applicable law does not allow all or any part of the below limitations of liability to apply to you, the limitations will apply to you only to the maximum extent permitted by applicable law.
    • Subject to the aforesaid, in No event shall we (including our parents, subsidiaries, affiliates, associates, officers, directors, shareholders, employees or agents) under any circumstances whatsoever be liable to you for any loss, damage (whether direct, indirect, punitive, actual, consequential, incidental, special, exemplary, or otherwise) costs, expenses, liabilities or penalties, whether in contract, tort, breach of statutory duty or otherwise, whether foreseeable or unknown, arising from, in connection with or relating to
    • Advice given through the Dimemoney Platform;
    • Services rendered through the Dimemoney Platform;
    • Your use of the Dimemoney Platform;
    • Any corruption or loss of data;
    • Any inability to access or use our Dimemoney Platform, including, without limitation, any interruptions, suspension or withdrawal of Dimemoney Platform (for any reason whatsoever);
    • Any use you make of any content or materials on Dimemoney Platform, including any reliance you make on such content or material;
    • Any loss of savings, profits, sales, business or revenue;
    • Any loss of reputation or goodwill;
    • Any loss of a chance or opportunity; or
    • Any other secondary, consequential, Notional or indirect losses.
  • And even if we have been advised of the possibility of such loss or damage, without limitation, you assume and shall be liable for the entire cost of all necessary servicing, repair or correction in the event of any such loss, damage, costs, expenses, liabilities or penalties arising.
  • We shall not be liable for any damage arising out of services rendered through Dimemoney platform that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us
  • You confirm that you have the requisite knowledge, expertise and experience to understand the risks involved in transacting any product or service offered through the Dimemoney Platform.
  • You specifically agree that we shall not be liable for any content or the defamatory, offensive or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
  • You agree that in the event that you incur any damages, losses or injuries arising out of, or in connection with, our acts or omissions, the damages, if any, caused to you are not irreparable or sufficient to entitle you to an injunction preventing any exploitation of any Platform, service, property, product or other content owned or controlled by us, and you will have no rights to enjoin or restrain the development, production, distribution, advertising, exhibition or exploitation of any Platform, property, product, service, or other content owned or controlled by us.
  • To the extent that any of the provisions under any of the act are unenforceable as outright exclusions of liability, they shall be construed as limitations on liability, limiting our liability to you to the maximum extent permitted by law

  • We may report any breach or suspected breach to the relevant authorities (including any law-enforcement agencies) and may disclose your identity and act.

Communication policy

  • By making use of the Website, and furnishing your personal/contact details, You hereby agree that you are interested in the services, offers, campaigns etc. that Dime or any other third party may offer/provide/share/send to you from time to time through any means including but not limited to telephone, SMS (short messaging service), electronic mail (e-mail), Whatsapp or any other messaging service/mobile application or any other physical, electronic or digital means/mode.
  • You specifically understand and agree that by using the Website you authorize Dime, its affiliates, partners and third parties to contact you for any follow up calls in relation to the services provided through the Website and for offering or inviting your interest in availing any other product or service offered by Dime or such third parties. You agree and consent to receive communications relating to all of the above on your phone/mobile number provided by you on the Website and expressly waive any registration or preference made under DND/NCPR list under the applicable TRAI regulations.
  • You will indemnify and hold harmless Dime and the SMS/e-mail service provider including its officials from any damages, claims, demands, proceedings, losses, costs, charges and expenses whatsoever including legal charges and attorney’s fees which Dime or the SMS/e-mail service provider may at any time incur, sustain, suffer or be subjected to as a consequence of, or arising out of, any of the following:
    • misuse by You; or
    • improper or fraudulent information provided by You; or
    • incorrect number or a number that belongs to an unrelated third party provided by You.
  • You agree and authorize Dime to share your information, with its group companies, vendors, service providers of Dime and other third parties, in so far as required for marketing purposes/offering various products and services and/or to provide you with various value-added services, in association with the services selected by you or generally otherwise.
  • You agree to receive communications through emails, telephone and/or SMS, from Dime or third parties. You also agree that Dime reserves the right to make your details available to its partner banks/financial institutions, vendors, service providers, business partners, agents or any other third party and that you may be contacted by such partners and/or the third party for information through email, telephone and/or SMS.

You also agree that Dime reserves the right to make your details available to its partner banks/financial institutions, vendors, service providers, business partners, agents or any other third party and that you may be contacted by such partners and/or the third party for information through email, telephone and/or SMS.

Third party services

  • We use OneMoney as our account aggregator partner to fetch your personal information. To use Dime you will have to create an account on OneMoney, which will be subject to its Terms & Conditions and Privacy Policy.
  • For providing You with services, Dime may use third-party products or services to you within the Website or redirect you to such third-party applications and websites. In order to use these third-party products or services, you may need to accept additional terms and conditions and meet additional requirements as specified by such third parties. Any redirection to a third-party page shall be governed by their terms and conditions and Dime will not be responsible for the same.
  • You acknowledge and agree that Dime shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
  • Your interaction with any third party accessed through the Website is at your own risk, and Dime will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any such third parties or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with the third parties.

Proprietary Rights & User License

  • You acknowledge and agree that Dime owns all rights, title and interest in and to the Website, including any intellectual property rights which subsist in the Website (whether registered or not). You further acknowledge that the Services may contain information which is designated confidential by Dime and that you shall not disclose such information without Dime's prior written consent.
  • Permission is granted to temporarily download one copy of the materials (information or software) on Dime's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    • modify or copy the materials;
    • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    • attempt to decompile or reverse engineer any software contained on Dime's website;
    • remove any copyright or other proprietary notations from the materials; or
    • transfer the materials to another person or "mirror" the materials on any other server.
  • The license shall automatically terminate if you violate any of these restrictions and upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Disclaimers

  • Dime reserves the right to discontinue or suspend, temporarily or permanently, the services including ancillary services offered on the Website, by giving reasonable time period notice, on a best effort basis, unless it is merely to change certain features/contents of the Website and/or maintain the security and integrity of the Website. You agree that Dime will not be liable to you in any manner whatsoever for any modification or discontinuance of the Website.
  • You agree not to use the services and ancillary services offered on the Website for illegal purposes or for the transmission of material that is unlawful, harassing, libelous (untrue and damaging to others), invasive of another’s privacy, abusive, threatening, or obscene, or that infringes the rights of other.
  • The materials on the Website are provided on an ‘as is‘ basis. Dime makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  • Dime does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Website or otherwise relating to such materials or on any sites linked to the Website.
  • Dime makes no warranty, and expressly disclaims any obligation, that: 1. the content will be up- to-date, complete, comprehensive, accurate or applicable to your circumstances; 2. The Website will meet your requirements or will be available on an uninterrupted, timely, secure, or error-free basis; 3. the results that may be obtained from the use of the Website or any services offered through the Website will be accurate or reliable; or 4. the quality of any products, services, information, or other material obtained by you through the Website will meet your expectations.
  • Any content provided by Dime on the website aimed for providing general awareness does not constitute investment advice or endorsement or solicitation by Dime. Such contents and/or information are derived from publicly available sources and Dime cannot verify or confirm the genuineness, authenticity or veracity of such information.
  • While availing any of the payment method/s available on the Website, Dime will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to: lack of authorization for any transaction/s, or any payment issues arising out of the transaction, or Illegitimacy of the payment methods (credit/debit card frauds etc.) being used by a you, Decline of transaction for any other reason(s).
  • Notwithstanding anything contained herein, the Website reserves the right to conduct additional verification for security or other reasons if it is not satisfied with the creditability of you/your transaction.
  • Use of the payment facilities provided by the Website shall not render the Website liable or responsible for the non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, non-provision of after sales or warranty services or fraud as regards the products or services listed on the Website. The Website shall not be responsible for any damages, interests or claims arising from not processing a transaction.
  • You hereby agree to provide accurate information, such as credit/debit information for purchasing any Service or product on or through the Website. You further warrant that you shall not use payment information or an instrument that is not lawfully owned by you.
  • In addition to these terms of use, the terms and conditions of the bank or other financial institution shall also be applicable to every user. The Website disclaims any liability arising out of declining of payment by such bank or financial institution.
  • In addition to the above, all the disclaimers specified under the terms and conditions of a specific product shall be deemed to be included in this TOS.

Termination

We reserve the right, in our sole and absolute discretion, to suspend or terminate your use of one or more services or product, offered by Dime without notice and without liability to you or any third party, for any reason, including without limitation, inactivity or violation of these TOS or other applicable policies we may publish from time to time. Any such termination may also result in termination of services by Banks or financial institutions that have partnered with Dime and Dime shall not be held liable for the same.

Indemnification & Limitation of Liability

  • You agree to indemnify and hold Dime (and its officers, directors, agents and employees) harmless from any and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including reasonable attorneys' fees, or arising out of or related to your breach of this TOS, your violation of any law or the rights of a third party, or your use of the Website, any dispute or litigation caused by your actions or omissions, your negligence and fraud committed by you.
  • Dime (including its officers, directors, employees, representatives, affiliates, group companies and providers) will not be responsible or liable for: (a) any injury, death, loss, claim, act of god, accident, delay, or any direct, special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arise out of or is in any way connected with (i) any failure or delay (including without limitation the use of or inability to use any component of the Website), or (ii) any use of the Website or content, or (iii) the performance or non-performance by Us or any provider, even if we have been advised of the possibility of damages to such parties or any other party, or (b) any damages to or viruses that may infect your computer equipment or other property as the result of your access to the Website or your downloading of any content from the Website.
  • The Website may provide links to other third-party websites. However, since Dime has no control over such third-party websites, you acknowledge and agree that Dime is not responsible for the availability of such third-party websites and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such third-party websites.
  • In any case the total cumulative liability of Dime arising out of or in relation to this TOS shall not exceed the net fees Dime may have received and retained from You for transactions undertaken during the three month period immediately preceding the date of claim.

Assignment & waiver

These TOS and any rights and licenses granted hereunder, may not be transferred or assigned by you. We may assign, in whole or in part, the benefits or obligations of this TOS, without requiring your prior consent. Unless otherwise expressly stated in this Agreement, the failure to exercise or delay in exercising a right or remedy under these TOS will not constitute a waiver of the right or remedy or a waiver of any other rights or remedies, and no single or partial exercise of any right or remedy under these TOS will prevent any further exercise of the right or remedy or the exercise of any other right or remedy.

Modifications

Dime may revise these terms of service for the Website at any time without notice. Continuing usage of the Website shall be deemed to be your agreement to be bound by the applicable version of these TOS as on the date of use of the Website. If you do not agree to the changes, you may discontinue your use of the services offered on the Website.

Severability

If any provision of this TOS is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from this TOS to the minimum extent required, and the remaining provisions will remain valid and enforceable.

Survival of agreement

Upon termination of this TOS, any provision which, by its nature or express terms should survive, will survive such termination or expiration as applied to transfers and relationships prior to such termination or expiration.

Governing Law & Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of the Republic of India. The courts of Bangalore, Karnataka shall have the exclusive jurisdiction to adjudicate on any disputes that arise out of or in connection with this TOS or your usage of the services offered by Dime.
